【Scope of Application】

  • Article 1 1.

    Accommodation contracts and related agreements concluded between this accommodation facility and guests shall be governed by these Terms and Conditions. Matters not specified herein shall be governed by laws and regulations (meaning laws, regulations, or rules based on laws or regulations; the same applies hereinafter) or generally established customs.

  • 2.

    Notwithstanding the preceding paragraph, if this accommodation facility agrees to special terms not contrary to laws, regulations, or established customs, such special terms shall take precedence.

【Application for Accommodation Contract】

  • Article 2 1.

    Persons wishing to apply for an accommodation contract with this facility shall provide the following information to this accommodation facility:

    • (1)Guest name and contact information
    • (2)Dates of stay and estimated arrival time
    • (3)Accommodation fee (in principle, based on the basic accommodation fee in Appendix Table 1)
    • (4)Applicant's name and contact information
    • (5)Other matters deemed necessary by this accommodation facility
  • 2.

    If a guest requests to extend their stay beyond the date specified in Item 2 of the preceding paragraph during their stay, this accommodation facility shall treat this request as a new application for an accommodation contract made at the time the request was made.

【Establishment of Accommodation Contract】

  • Article 3 1.

    The accommodation contract shall be established when this accommodation facility accepts the application referred to in the preceding article. However, this shall not apply if this accommodation facility proves that it did not accept the application.

  • 2.

    When the accommodation contract is established pursuant to the preceding paragraph, the applicant shall pay the application fee specified by this accommodation facility, up to the basic accommodation fee for the accommodation period, by the date specified by this accommodation facility.

  • 3.

    The application fee shall first be applied to the final accommodation charges payable by the guest. Should circumstances arise where the provisions of Article 6 and Article 18 apply, the fee shall be applied in the order of liquidated damages followed by compensation. Any remaining balance shall be refunded upon payment of charges pursuant to Article 12.

  • 4.

    If the application fee specified in Paragraph 2 is not paid by the date designated by this accommodation facility pursuant to the provisions of that paragraph, the lodging contract shall lose its effect. However, this shall only apply if this accommodation facility has notified the guest of the designated payment date for the application fee.

【Special Agreement Exempting Payment of Application Fee】

  • Article 4 1.

    Notwithstanding the provisions of Paragraph 2 of the preceding Article, this lodging facility may agree to a special arrangement exempting the payment of the application fee specified in said paragraph after the contract has been concluded.

  • 2.

    If, upon accepting an application for a lodging contract, this lodging facility did not request payment of the application fee specified in Paragraph 2 of the preceding Article or did not specify a payment date for said application fee, it shall be treated as having agreed to the special provision in the preceding paragraph.

【Requests for Cooperation with Infection Prevention Measures at the Facility】

  • Article 4-2.

    This lodging facility may request cooperation from persons intending to stay in accordance with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).

【Refusal to Conclude an Accommodation Contract】

  • Article 5 1.

    This facility may refuse to conclude an accommodation contract in the following cases. However, this paragraph does not imply that this accommodation facility may refuse lodging in cases other than those listed in Article 5 of the Hotel Business Act.

    • (1)When the accommodation request does not comply with these terms and conditions.
    • (2)When there are no available rooms due to full occupancy.
    • (3)When the person seeking accommodation is deemed likely to engage in conduct contrary to laws and regulations, public order, or public morals regarding the accommodation.
    • (4)When the person seeking accommodation has a history of delayed payment or similar issues with this accommodation facility.
    • (5)When the person seeking lodging is deemed to fall under any of the following subparagraphs (a) to (c):
      • (a) A member of an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991)(hereinafter referred to as “organized crime groups”), an organized crime group member as defined in Article 2, Item 6 of the same Act (hereinafter referred to as “organized crime group members”), quasi-members of organized crime groups, persons associated with organized crime groups, or other antisocial forces.
      • (b) When the prospective guest is a corporation or other organization whose business activities are controlled by an organized crime group or organized crime group members.
      • (c) When the prospective guest is a corporation that has an officer who falls under the definition of an organized crime group member.
    • (6)When the person seeking lodging has engaged in conduct causing significant nuisance to other guests.
    • (7)When the person seeking lodging is a patient, etc., of a specified infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act (hereinafter referred to as “patient, etc., of a specified infectious disease”).
    • (8)When the person seeking lodging is clearly found to be in poor physical or mental condition.
    • (9)When the person seeking lodging is a minor without written permission from a parent or guardian.
    • (10)When the person seeking lodging is intoxicated or otherwise likely to cause nuisance to other guests.
    • (11)When this lodging facility determines the application for lodging was made for the purpose of transferring the right to stay to another party.
    • (12)When violent demands are made regarding lodging, or when demands are made that impose an unreasonable burden. (Accommodation is requested by a person seeking accommodation who is demanding the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities (Act No. 65 of 2013; hereinafter referred to as the “Act on the Elimination of Discrimination against Persons with Disabilities”).)
    • (13)When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable reasons.
    • (14)When the circumstances fall under the provisions of ordinances of the prefecture where this lodging facility is located.
    • (15)When the person seeking lodging repeatedly makes demands to this lodging facility that are deemed to impose an excessive burden on its implementation and are likely to significantly impede the provision of lodging services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act.

【Explanation of Refusal to Conclude Accommodation Contract】

  • Article 5-2.

    A person seeking accommodation may request an explanation from this accommodation facility regarding the reasons for its refusal to conclude an accommodation contract based on the preceding article.

【Guest's Right to Cancel the Contract】

  • Article 6-1.

    A guest may cancel the accommodation contract by notifying this accommodation facility.

  • 2.

    If a guest cancels all or part of the accommodation contract for reasons attributable to the guest (excluding cases where the accommodation facility specified a payment date for the application fee under Article 3, Paragraph 2 and requested payment, and the guest cancels the contract before making such payment), the accommodation facility shall charge a cancellation fee as set forth in Appendix Table 2. However, this shall only apply if the accommodation facility has informed the guest of the obligation to pay a cancellation fee upon termination when agreeing to the special arrangement under Article 4, Paragraph 1.

  • 3.

    If a guest fails to arrive by 8:00 PM on the scheduled arrival date (or two hours after the specified arrival time, if one was provided in advance) without contacting the hotel, the hotel may treat the accommodation contract as having been canceled by the guest.

【Right of Termination by This Facility】

  • Article 7 1.

    This lodging facility may terminate the lodging contract in the following cases. However, this clause does not imply that this facility may refuse lodging except in the cases listed in Article 5 of the Hotel Business Act.

    • (1)When it is deemed likely that a guest will engage in conduct related to lodging that violates laws and regulations, public order, or public morals, or when such conduct is deemed to have occurred.
    • (2)When a guest is deemed to fall under any of the following subparagraphs (a) to (c):
      • (a) Organized crime groups, members of organized crime groups, quasi-members of organized crime groups, persons associated with organized crime groups, or other antisocial forces
      • (b) The guest is a corporation or other organization controlled by a violent group or its members in their business activities.
      • (c) The guest is a corporation with officers who are members of a violent group.
    • (3)When the guest is a patient with a specified infectious disease, etc.
    • (4)When violent demands are made regarding lodging, or when burdens exceeding a reasonable scope are requested. (Excluding cases where the guest requests removal of social barriers under Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities)
    • (5)When accommodation cannot be provided due to reasons attributable to force majeure such as natural disasters.
    • (6)When the person seeking accommodation is deemed likely to cause significant inconvenience to other guests due to being heavily intoxicated, etc., or when the person has engaged in behavior causing significant nuisance to other guests.
    • (7)When the person fails to comply with prohibited acts specified in the facility's usage rules (limited to those necessary for fire prevention), such as smoking in bed in bedrooms, tampering with firefighting equipment, etc. When the case falls under the provisions of Article 5 of the Oita Prefecture Inn Business Act Enforcement Ordinance.
    • (8)When the guest falls under the provisions of ordinances of the prefecture where this lodging facility is located.
    • (9)When a guest repeatedly makes demands to this lodging facility that, due to the burden of implementation, are deemed likely to significantly impede the provision of lodging services to guests, as specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act.
  • 2.

    When this lodging facility cancels the lodging contract based on the preceding paragraph, no charges shall be levied for lodging services or other services not yet provided to the guest.

【Explanation of Contract Cancellation】

  • Article 7-2.

    A guest may request an explanation of the reasons from this lodging facility when the facility cancels the lodging contract based on the preceding article.

【Accommodation Registration】

  • Article 8 1.

    Guests shall register the following information at the hotel front desk on the day of their stay:

    • (1)Guest's name, age, gender, address, contact information, and occupation
    • (2)For foreign nationals without a registered address in Japan: nationality, passport number, port of entry, and date of entry (a copy of the passport will be taken for verification purposes)
    • (3)Departure date and scheduled departure time
    • (4)Other information deemed necessary by the hotel
  • 2.

    When a guest intends to pay the fees specified in Article 12 using a lodging voucher, credit card, or other method equivalent to currency, they must present such items at the time of registration as described in the preceding paragraph.

【Room Usage Hours】

  • Article 9 1.

    Guests may use their rooms during the hours specified in the facility's information. However, for consecutive stays, rooms may be used throughout the day, excluding the arrival and departure dates.

  • 2.

    Notwithstanding the preceding paragraph, the facility may permit room usage outside the hours specified therein. In such cases, an additional fee will be charged.

【Compliance with Usage Rules】

  • Article 10.

    Guests shall comply with the usage rules established and posted within the accommodation facility.

【Business Hours】

  • Article 11 1.

    The business hours for the accommodation facility's main facilities are indicated in the provided pamphlets, posted information at various locations, and the information guide for the facility.

  • 2.

    The hours stated in the preceding paragraph may be temporarily changed when necessary and unavoidable. In such cases, notification will be provided by appropriate means.

【Payment of Fees】

  • Article 12 1.

    The breakdown of lodging fees and other charges payable by the guest shall be as listed in Appendix Table 1.

  • 2.

    Payment of the lodging fees and other charges specified in the preceding paragraph shall be made at the front desk upon the guest's departure or when requested by the accommodation facility, using Japanese currency or methods acceptable to the accommodation facility, such as lodging vouchers or credit cards.

  • 3.

    Even if a guest voluntarily chooses not to stay after the accommodation facility has provided a guest room and made it available for use, lodging fees shall be charged.

【Liability of the Facility】

  • Article 13 1.

    This accommodation facility shall compensate the guest for any damages caused by the performance or non-performance of the lodging contract and related contracts. However, this shall not apply if the damages were not attributable to the facility's fault.

  • 2.

    This accommodation facility maintains lodging liability insurance to address unforeseen events such as fire.

【Handling When Contracted Rooms Cannot Be Provided】

  • Article 14 1.

    If this accommodation facility cannot provide the contracted room to a guest, it shall, with the guest's consent, arrange alternative accommodation at another facility under conditions as similar as possible.

  • 2.

    Notwithstanding the preceding paragraph, if this accommodation facility cannot arrange alternative lodging, it shall pay the guest compensation equivalent to the penalty fee amount. This compensation shall be applied toward damages. However, no compensation shall be paid if the inability to provide the room is not attributable to this facility.

【Handling of Deposited Items】

  • Article 15 1.

    If loss, damage, or other harm occurs to items, cash, or valuables deposited by a guest at the front desk, the hotel shall compensate for such damage, except in cases of force majeure. However, for cash and valuables, if the hotel requested the guest to declare the type and value and the guest failed to do so, the hotel shall compensate for damages up to a maximum of 100,000 yen.

  • 2.

    If loss, damage, or other harm occurs to items, cash, or valuables brought into the accommodation facility by the guest but not deposited at the front desk, due to the intentional act or negligence of the accommodation facility, the accommodation facility shall compensate for such damage. However, for items for which the guest did not previously declare the type and value, the hotel shall compensate for damages up to a maximum of ¥100,000, except in cases of intentional misconduct or gross negligence on the part of the hotel.

【Storage of Guest Luggage or Personal Belongings】

  • Article 16 1.

    If a guest's luggage arrives at the accommodation facility prior to their check-in, the facility shall store it responsibly only if the facility has agreed to this storage before the luggage's arrival. The luggage shall be handed over to the guest at the front desk upon check-in.

  • 2.

    If, after a guest has checked out, their luggage or personal belongings (excluding valuables) are left behind at the accommodation facility, such items shall be deemed to have been transferred to the possession of the hotel. The hotel shall, in principle, wait for contact from the owner and seek their instructions. However, if no instructions are received within one month, the items shall be disposed of. Food, beverages, tobacco, magazines, etc., shall be disposed of immediately. Regarding valuables, if no instructions are received from the owner, they will be reported to the police station as lost property in accordance with the Lost Property Act.

  • 3.

    The responsibility of this accommodation facility for storing guests' luggage or personal belongings in the cases described in the preceding two paragraphs shall be governed by the provisions of the preceding article, paragraph 1 in the case of paragraph 1 above, and by the provisions of the same article, paragraph 2 in the case of the preceding paragraph.

  • 4.

    This accommodation facility may, at its discretion, inspect the contents of any left-behind luggage or personal belongings to determine appropriate handling based on the nature of the contents. It may then return them to the owner or handle them in accordance with the preceding paragraph as necessary. Guests shall not raise any objection to this.

【Parking Responsibility】

  • Article 17-1.

    When guests use the parking lot of this accommodation facility, regardless of whether vehicle keys are deposited, the facility merely provides the space and does not assume responsibility for managing the vehicles. However, if damage occurs due to the facility's intentional act or negligence in managing the parking lot, the facility shall be liable for compensation.

【Guest Liability】

  • Article 18 1.

    If the hotel suffers damage due to a guest's intentional act or negligence, the guest shall compensate the hotel for such damage.

  • 2.

    Smoking is prohibited throughout the accommodation facility except in designated smoking areas. If a guest is found smoking in a guest room or any area other than the designated smoking areas within the facility, the guest shall compensate the accommodation facility for the room cleaning fee and damages related to the suspension of room sales, as set forth in Appendix Table 3.

【Disclaimer】

  • Article 19.

    Use of computer communications from within this accommodation facility shall be at the user's own risk. The accommodation facility shall bear no responsibility whatsoever for any damages incurred by the user resulting from service interruptions due to system failures or other reasons during computer communication use. Furthermore, if the user's actions deemed inappropriate by the accommodation facility during computer communication cause damage to the accommodation facility or a third party, the user shall compensate for such damage.

【Governing Language】

  • Article 20.

    These Terms and Conditions are prepared in Japanese, English, Chinese, and Korean. However, if any inconsistency or discrepancy exists between the terms in any language, the Japanese text shall prevail in all respects.

【Revision of Accommodation Terms】

  • Article 21.

    These Accommodation Terms may be revised as necessary at any time. Should these Terms be revised, the accommodation facility shall display the revised Terms' content and effective date on the accommodation facility's website or within the accommodation facility.

(Note) 1. The percentage represents the ratio of the penalty fee to the base accommodation fee.

2.If the contracted number of days is shortened, a penalty fee will be charged for the first day of accommodation that is no longer utilized due to the shortening, regardless of the number of days shortened, starting from the date the notification is received.

3.If a portion of a group booking for 15 or more people is canceled, no penalty fee will be charged for a number of guests equal to 10% of the total number of guests scheduled to stay as of 8 days prior to the stay (or the date the reservation was accepted if accepted after that date), rounded up to the nearest whole number.

4.Additionally, special plans sold by partner businesses or this accommodation facility, as well as specific groups, may stipulate cancellation fees that differ from the aforementioned provisions.
